Cross Examination of the CPS Interviewer

Cross Examination of the CPS Interviewer

The forensic interviewer is the person who interviewed the child on video. In the majority of cases, the video does not come into evidence. This is because the video is repetitious, and bolsters the testimony of the child. The interviewer will probably testify that she asked the child non-leading questions. She will say that the child was able to answer the questions and tell her what she felt, saw, or smelled. The interviewer will probably testify that the child was consistent.

It is my opinion that the interviewers often do not know very much about the actual cases. So, I think it is a good idea to cross-examine them about what they do not know. They do not know who spoke with the child. In addition, they are often not well versed on the psychological data that exists about false allegations of child abuse. Basically, these interviewers are advocates for the children. Hopefully, the jury will able to see that they always testify for the state.
